Important Guarantee Notice for Our Customers:

 

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

 

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be lawfully excluded.

3. Online Store & Eligibility

Age Requirement: By agreeing to these Terms, you represent that you are at least the age of majority in your Australian State or Territory of residence, or that you have given us consent to allow any of your minor dependents to use this site.

 

Prohibited Uses: You may not use our products or site for any illegal, unauthorized, or fraudulent purpose, nor may you transmit any viruses, malicious code, or automated scraping tools. 

 

Account Abuse: We reserve the right to refuse service, terminate accounts, or cancel orders at our reasonable discretion if fraudulent activity or a breach of these Terms is detected.

4. Product Information, Sourcing & Accuracy

Product Descriptions: We make every effort to display product details, fabric blends, and sizing as accurately as possible. However, because monitor displays vary, we cannot guarantee that your device’s display of any color will be 100% exact.

 

Textile & Certification Claims: Our sleepwear is crafted with care using specialized fabric blends (such as bamboo viscose, organic cotton yarn, and spandex). Fabric components holding individual certifications (such as OEKO-TEX® Standard 100 and GOTS-certified yarns) are sourced from certified suppliers as detailed on our site product pages and FAQ section.

 

Our garments are thoughtfully designed in Australia.

5. Pricing, Orders & Payments

Currency & GST: All prices listed on the site are displayed in Australian Dollars (AUD). Prices are inclusive of 10% Australian Goods and Services Tax (GST) where applicable.

 

Price Changes: Prices for our products are subject to change without prior notice.

 

Order Refusals & Refunds: We reserve the right to limit or cancel quantities purchased per person, household, or order. If we modify or cancel an order after payment has been taken, we will issue a full refund to your original payment method within a reasonable processing timeframe.

6. Shipping & Returns

Shipping rates, transit times, and returns are governed by our Shipping & Refund Policy.

 

Return Window: Eligible unworn, unwashed items in original condition may be returned within 30 days of receipt.

 

Incorrect Delivery Details: Customers are responsible for ensuring that all shipping address details entered at checkout are complete and accurate. Hushloom is not responsible for missing orders resulting from incorrectly entered shipping information.

7. Intellectual Property

All content on this website, including but not limited to the Hushloom brand name, logos, product designs, imagery, graphics, and written copy is the exclusive intellectual property of Hushloom and is protected under Australian and international copyright and trademark laws. Unauthorised reproduction, distribution, or commercial exploitation of any site content is strictly prohibited.

8. Limitation of Liability

To the maximum extent permitted by law (and subject strictly to Section 2 regarding statutory Australian Consumer Law guarantees):

 

Hushloom shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or products.
 

In all circumstances where liability cannot be fully excluded by law but can be limited, our maximum aggregate liability to you is limited to the repair, replacement, or resupply of the affected products, or a full refund of the purchase price paid.

9. Governing Law & Jurisdiction

These Terms of Service, and any separate agreements whereby we provide you goods or services, shall be governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts operating in Victoria to resolve any legal dispute.
